1. Scope and definition

These General Terms and Conditions of Sale (the “GTCS” or “T&C”) are translated for the French version. In case of any contradictions, it will be the original version which is leading. The T&C apply as soon as you access the online store www.aube-collection.com (the “Site”) or place orders to purchase one or more products presented on the Site.
Any reference to “we”, “us” or “our” in these T&Cs refers to QUOVIS BV, the owner of the AUBE trademark, and any reference to “you”, “your” or “yours” refers to you, the user of the Site.
Please read these terms and conditions carefully before using the Site and placing your order. By accessing any part of the Website or ordering products from the Website, you agree to be bound by these Terms and Conditions.

QUOVIS BV may modify the T&C at any time by posting the modification in question on the Site. Any use by you after the modification has been posted constitutes acceptance of the T&Cs as modified.

QUOVIS BV registered in the Antwerp Commece Register under number 0819 467 678 is the seller of the products presented on the Site.

3. Prerequisites

The customer declares and acknowledges :

  • Be of legal age and have full legal capacity to enter into commitments under the GTCS;
  • That acceptance of the General Terms and Conditions and the order of products takes the form of consent by “click”;
  • That he/she is acting as a consumer, i.e. that the acquisition of the products is exclusively intended for his/her personal and private use.

4. Site access conditions

We strive to provide quality access and to enable users to use the site and its functionalities in the best possible conditions. QUOVIS BV reserves the right, without notice or compensation, to temporarily or permanently close the site or access to one or more remote services, in particular to carry out updates, maintenance operations, modifications or changes to operating methods, servers and accessibility times, without this list being limitative.

We also strive to protect the Site from computer viruses and other malicious software. In view of the risks involved in using the Internet, it is your responsibility to take the necessary precautions to protect your computer and your system. We cannot be held responsible for the use or inability to use the Site or for any damage or loss caused.

QUOVIS BV is not responsible for damages of any kind that may result from these changes and/or from the temporary unavailability or permanent closure of all or part of the site or its associated services.

5. The right to refuse orders

QUOVIS BV reserves the right to cancel an order in the event of an existing dispute with the customer or a technical problem leading to the display of a derisory price in relation to the reference price of the product (price indicated in the catalog of the current collection).

We remind you that this Site is exclusively intended for consumers. Purchases made from the Website are for your personal use, including personal gifts, and shall not be resold, used in a commercial context or used for commercial gain. We reserve the right to refuse orders for multiple quantities of the same item from a single customer or to a single postal address.

6. Product information

We take great care to ensure that the information relating to the products offered for sale on the Site is accurate and up-to-date. However, QUOVIS BV cannot be held responsible for any errors or omissions in the presentation of the products.

The photographs and other graphic illustrations of the products presented on the Site are merely indicative, although we make every effort to present quality visual material. The customer is fully aware that the images, photos and colors of the items offered for sale may not correspond exactly to the actual colors due to the effect of the Internet browser and the screen used.

The photographs and texts illustrating the products are not contractual.

7. Price

The price of the products you order is the price displayed on the Site at the time you confirm your order. All prices are quoted in Euro, including VAT and excluding shipping costs. Postage and packing costs, which are invoiced in addition, will be specified at the time of final validation of the order. Prices are subject to change depending on a number of criteria, such as commercial operations, etc.

QUOVIS BV reserves the right to modify its prices at any time, but products will be invoiced on the basis of the prices in force at the time the order is registered, subject to product availability. The products remain the property of QUOVIS BV until full payment has been received.

8. Online ordering

Customers ordering directly from www.aube-collection.com must follow the steps below:

  • Step 1: On their first visit, customers are asked to fill in a form containing the following information: surname, first name, full delivery address, e-mail and telephone number. Once a user has registered, he or she can log in on subsequent visits by entering his or her e-mail address and password.
  • Step 2: Choosing products and filling the basket.
  • Step 3: Access to basket details. At this stage, the customer can check the details of his basket and its total price, excluding any delivery charges, modify it and/or delete products. It is at this stage that the customer will be able to enter a promo code and/or gift card code, if applicable.
  • Step 4: Order summary, choice of delivery address.
  • Step 5: Any delivery charges are then indicated. They may vary according to the country of delivery.
  • Step 6: Choice of payment method, choice of billing address.
  • Step 7: Confirmation and payment of the order, including acceptance of the T&Cs.

Once validated and paid, the order cannot be modified by the customer, subject to the provisions of point 13.

9. Payment

The payment methods we accept are mentioned on the Site. Payment must be made in euros.

In the event of refusal of payment by the customer’s bank, the order cannot be finalized and the sale cannot be concluded.

The products remain the property of QUOVIS BV until we have received full payment of the price and shipping costs. Even if AUBE is the seller, payments must be made to the QUOVIS BV bank account, details of which are displayed on the payment pages of the Site.

10. Delivery

Delivery will be made by a professional service provider. Charges vary according to the country of delivery and are indicated at the time of validation of the order placed on the Site.

Products are delivered to the address indicated by the customer on the Site’s order interface.

Please note that for Denmark and Sweden, delivery is only made to a DHL relay point.

Delivery times are specified to the customer after the order is placed in the order tracking system.

All orders validated on Friday can be dispatched from the following Tuesday. The delivery times indicated are indicative from the day following validation of the order by the customer. They correspond to product processing and delivery times. Under no circumstances will they be enforceable, but in the event of unusual delays, an e-mail will be sent to you. QUOVIS BV therefore declines all responsibility in the event of excessively long delivery times due to postal services or means of transport, as well as in the event of loss of ordered products or strikes.

If no one is present at the time of delivery, you will be asked to contact the transport service to arrange an alternative delivery date.
In the event of a delay of more than thirty (30) days in relation to the delivery date specified in the order validation email, you will have the option of proposing a new delivery date or cancelling your order and you will be reimbursed.

Any risk of damage to the products is transferred to the customer at the time the customer takes physical possession of the products.
In the case of orders from private individuals to collective addresses such as offices, nursing homes or residential establishments, the customer acknowledges that QUOVIS BV’s obligation to deliver the order ends with the actual delivery to the collective address indicated on the order form, even if the shipment is not received by the final recipient but by a third party.

PO Box and military APO addresses are not accepted.

We deliver Monday to Friday, except on public holidays.

11. Defective products or delivery error

On delivery, please inspect the package for any damage. If products are damaged or do not correspond to your order, please contact us via the contact form on the Site within a maximum of 3 days. Then follow the returns procedure described in point 12 below.

12. Return policy and procedure

Return policy

You have 14 days after receipt of your order to return the product for a refund. Returns within Europe are free of charge. The procedure only concerns products purchased online on the AUBE platform.

Upon receipt of the return and after validation of the good condition of the item, AUBE will reimburse the amount of the item by the same means of payment used for the purchase (delivery charges paid at the time of order will not be reimbursed).

Returned products must be unused and in their original packaging. The outer label must be present on the product.
AUBE reserves the right to refuse any return that does not meet these conditions.

To return an item purchased in a boutique, please contact the boutique where you made your purchase.

Return procedure

We thank you for using the return procedure described below in the event that you return a product as described in point 13 after contacting us and receiving our return validation or when exercising your right of withdrawal as described in point 15.

The procedure only concerns products purchased online on the AUBE platform.
Returns of items purchased online will not be accepted in store and vice versa.
On the return portal :

  1. Please use the Contact form on the website or send an email to contact@aube-collection.com.
  2. Mention your order number and the reason for the return.
  3. We will email you a pre-paid return label.
  4. Print the return label.
  5. Pack the item(s) in the original packaging or carton. Stick the return label on the carton, making sure that the original label is well covered.
  6. Drop off the parcel at the nearest DHL point. Once the product has been scanned, you’ll receive confirmation of shipment by email, together with a tracking number.
  7. Upon receipt of the returned products, they will be processed by our teams. After validation, the refund will be processed. Please note that the return process may take up to 14 days.

Please note that returns from France are currently not possible with DHL. Another service provider will be used. The procedure described above is identical.

13. Right of withdrawal

You have the right to withdraw from this contract without giving any reason within fourteen days. This period runs from receipt of the goods.

To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract using the contact form on our Site and return the goods as indicated in point 12.

Once your return has been received and validated by our team, we will proceed with the refund using the same payment method you used for the initial transaction. The amount refunded will be that of the returned product less shipping costs.

14. Warranty

AUBE products are covered by a 2-year legal warranty from the date of purchase, provided they have been used under normal conditions and in accordance with their intended use. Products damaged by wear and tear are not considered defective.

The warranty covers products said to be ‘faulty’ due to a manufacturing defect.

Before returning a product, please contact our customer service department via the contact page on the Site.
Please attach proof of purchase and photos of your defective product to your message. If the defect is validated by our teams and the 2-year warranty period after the date of purchase is respected, a prepaid return slip will be sent to you. We will repair or exchange it. In the event that the product is no longer in stock, we will proceed with the refund.

If the item was purchased in a store, please contact the store where you made your purchase.

15. Limitations of use and intellectual property rights

All elements of the Site, whether visual or audio, including text, are protected by copyright, trademarks or patents. They are the property of QUOVIS BV

16. Regulation on the processing of personal data

Your privacy is very important to us. We invite you to read the section on our regulations concerning the processing of personal data on the Site. By placing an order on the Site, you authorize the collection, use and transfer of your personal data within the framework of the provisions of the regulations governing the processing of personal data.

17. Applicable law

Any dispute relating to the validity, interpretation and/or implementation of the GTC shall be governed exclusively by Belgian law and settled by the Belgian courts in Antwerp.
